Are There Ethical Federal Judges??

1. In reviewing cases some judges decisions stand out – “as justice prevails.”

11 th Circuit Appellate Court Justices

Justices Dubina and Barkett

reveal their ethics and deliver justice in their decision regarding US vs. Peters 310 F.3d 709 (11 th Cir 2002). Also taking part in that discussion was Judge Dennis Fitzpatrick, a district judge for the Middle District of Georgia.

These justices found that: when a court without proper jurisdiction convicts and sentences a defendant; the conviction and sentence are “void” from their “inception” and remain void long after a defendant has fully suffered their court’s direct force.

In the Peters’ case the appellate court justices, Dubina, Barkett and Fitzpatrick essentially found, that Peters, the defendant, had plead guilty to a crime of fraud that was not a crime at all. Therefore, the District court held no jurisdiction to accept a guilty plea, or sentence Mr. Peters to imprisonment.Jurisdiction is an important issue as Federal courts have limited jurisdiction. Defense attorneys constantly overlook the challenge to Federal jurisdiction when defending their clients; while innocent people are placed in prisons across the United States.

Regarding “Federal Court Jurisdiction”

11 th Circuit Appellate Judges Dubinaand Marcus, and Judge Hill discuss and define jurisdiction of the Federal courts. Again it is pointed out by these appellate judges the Federal courts do not have jurisdiction to act if a Federal prosecutor does not follow the rules.

Justice Marcus is again involved in writing the opinion regarding Federal Court’s jurisdiction in Worldwide Web Systems/Valdez vs. James Fettman, 328 F.3d 1291-1299 (11 th Cir 2003). Justice Marcus points out instances when a Federal Court would be without jurisdiction and a judgment would be void. Justice Marcus additionally points out the difference between subject matter and personal jurisdiction. Again jurisdictional issues are being brought forth, and being reviewed more closely in latter years; as over zealous corrupt Federal prosecutors are pressuring Federal judges to act without jurisdiction. Some Federal prosecutors just plain violate the law; invent crimes; trample on defendant’s constitutional rights, rendering the courts void of jurisdiction. Of course Federal judges in some instances do the same thing violating their oaths.

It appears that 11 th Circuit Court of Appeals justices, “Dubina”, “Barkett”, and “Marcus” appear to be a “very ethical” team on the 11 th Circuit Court of Appeals in Atlanta, Georgia.
