The “law” dictates exactly how
the hole is to operate.

!!The BOP violates most every law!!

1. The Code Of Federal Regulations (CFR) mainly CFR 28 § 541 dictates to the employees of the BOP just exactly “how” the “hole” (Special Housing Unit; segregation; detention;) is to function to comply with the laws that it “must”.

Tortures and kills prisoners

2. TheCode Of Federal Regulations (CFR) was instituted to prevent employees of the BOP from violating prisoner’s constitutional rights under the Eighth Amendment; to “prevent” cruel and abusive treatment, torture and murder.

3. Title 28 § 541 of the CFR states for the most part the following:

A. Noprisoner shall be put in the hole in serious medical condition.

(1) The BOP continually places prisoners in the hole in serious medical condition, and removes their medications. Some prisoners are deliberately placed in the hole in serious medical conditions and refused medical treatment in an attempt to kill them. Review Torture and DeathCamps at the top of this page; then Victims, then #7 James T. Kimball; #3 Prisoner Rodriguez; #13 Scotte E. Jackson; #10 Bruce Linder. This torture and death is common practice in the BOP.

B. The hole must be lighted; appropriately heated and in a sanitary condition at all times.

(1) Many of the cells in the hole; lights do not work; are controlled by the BOP officers that operate the hole; and are shut off deliberately. The holes are exceedingly cold, and only one T-shirt is provided for clothing along with their elastic pants. The showers have no hot or cold water controls, are usually scalding hot. The BOP refuses to provide warm clothing. The hole cells are usually filthy. There are at least 50,000 prisoners that would attest to these facts; and some of their stories are on this web site with more forthcoming.

C. Everyprisoner in the hole must be provided a bed, a mattress, blankets and a pillow.

(1) The BOP “laughs” at that “law.” Myself along with thousands of other prisoners were deprived of beds. Not only in the hold does the BOP refuse to provide beds; beds are not provided in the normal prisoner housing units. I, along with thousands of other Federal prisoners slept on the cement floor of two different prisons, Coleman/Low Security Prison, and Atlanta Federal Prison. At Yazoo/Low Security Prison, I was refused a mattress sleeping on a steel slab, with no pillow. No beds,no mattresses,no pillows are not abnormal in the hole or in standard housing units. Thousands of prisoners would attest to that fact. Additionally, in the holes the BOP operates throughout the US, it appears none of the bunk beds have ladders or guard rails. Prisoners constantly fall, either getting up, or down from the top bunk; or falling out of the top bunk onto the cement floor. Many are seriously injured. Does the BOP care? No!! Do they correct the problem? No.

(2) Review Torture and Death Camps ; then Victims; then #16 Walter Gothard; #9 Charles Harmon. In prisoner Harmon’s case, Harmon just happened to be designated to the BOP’spunishment low security prison in Yazoo, Mississippi. The BOP placed a 60-year man (Harmon) in an upper bunk which had no ladder or guard rail in their regular housing unit; NOT the hole. Yazoo as a punishment prison has many beds without ladders or guard rails in their normal punishment housing units. In fact Yazoo unlike other prisons I have been at, have the same beds used in the hole throughout all their housing units, for a little extra punishment. Mr. Harmon almost died from his fall and BOP medical neglect; and will be unable to walk properly, or live without some sort of pain the rest of his life. Mr. Harmon’s tragedy happened in September of 2003. Do you think the Regional Director “R. E. Holt” ordered ladders and guard rails be placed on any top bunk beds in the housing units or the hole at Yazoo? Of course NOT!! BOP Regional Director Holt wants to wait and see just how many prisoners he can further torture and cause permanent physical damage to while they are in prison. Prisoner Harmon is now released and he’ll have to live with what Mr. R. E. Holt did to him the rest of his life.

D. The hole must “NOT” have “strip cells” and if strip cells are to be in an institution they“must” be part of the “medical facility and under “control” of “medical staff.”

(1) Another joke around the BOP as they laugh at the law. Strip cells are in every BOP hole Kimball has been in; are filthy dirty and Kimball was forced to eat off the floor in the strip cells in the hole at Coleman/Low Prison in Coleman, Florida. No strip cells Kimball, or any of the thousands of prisoners Kimball has spoken to ever saw any strip cell operated by medical staff.

(2) Strip cells, or rooms are at every area in the BOP where visitation takes place. Each prisoner is locked in a room, with 2-4 other prisoners strip-searched together. They are forced to step on the floor in their bare feet; where a 100 or more other prisoners stood in their bare feet; spreading all kinds of foot fungus to one another. No medical staff exists in those strip areas.

E. Prisonersplaced in the hole for investigation, called administrative detention by the BOP “shall” receive the same general privileges as prisoners in the general population.

(1) Another joke as the BOP laughs at that law and their own policy which states what items a prisoner can have in the hole. The BOP consistently violates the Federal law with prisoners placed in the hole under alleged investigation; by providing these prisoners less than what by law prisoners must be provided in disciplinary detention. Kimball and thousands of other prisoners were placed in the hole under deliberate false investigations (Administrative Detention) and not only were not provided what the law states must be provided under disciplinary detention; the BOP refused to abide by their own policy/law under BOP Policy # PS.5270.07.

The BOP tortures and belittles every prisoner that self-surrenders and is immediately placed in the hole; or is placed in the hole under some sort of phony investigation, with no charges every being filed. This happened quite often at Coleman Low and Yazoo Low federal prisons.

legislature law; and human rights

In direct violation of a number of laws, rules and regulations, when a prisoner first comes into a BOP prison and placed in the hole, or in the hole under an alleged BOP investigations the following BOP acts; at bare minimum, the prisoner will endure during his visit to the hole:

1. Each prisoner will be strip-searched a number of times in strip cells in the hole in violation of the law.

2. Each prisoner will not be able to wear normal clothing worn within the prison, as directed by law. They will be provided one used pair of paper thin shorts; one used pair of boxer shorts and one thin T-shirt to wear at approximately 65 degree temperature in the hole.

3. In violation of the law the BOP will allow each prisoner exchange their clothing articles mentioned in (b); 3 times a week (only). Even if the prisoner is allowed to go outside in a cage for an hour of exercise; getting all sweaty. He must wear the same sweaty clothing at least 2 nights and 2 days.

4. The showers in the hole are substandard, without hot and cold controls and are usually scalding hot.

5. Exercise is in violation of the law also. The normal exercise allowed in the hole is 1 hour in a small cage, 3 days a week. Other than those 3 hours per week in a cage, about 30’ X20’; the prisoner is confined to a cell approximately 4’ X 10’ including the shower, john, and sink.

6. Every time a prisoner is let out of their tiny cell, their hands are handcuffed behind their back, no matter where they go. Even going to the medical department the arms of prisoners are handcuffed behind their back.

7. When a prisoner in the hold is taken to visit, he is stripped searched 2 – 4 times. He is dressed in bright orange, so all inmates and visitors can identify him as a very dangerous hardened criminal. He must sit in a special section at visitation in bright orange so all visitors can view this killer criminal. The hole prisoner cannot go out on the patio; he must sit in the certain section of the visiting room allotted to only prisoners in the hole so they can be stared at as very dangerous criminals by both visitors and other prisoners. The hole prisoners are not even allowed to speak to other prisoners or their families. All this is in total violation of the law. However, the BOP does not know what the law is, the legislature passed. They make up their own inhumane laws and are accountable to no-one.

8. When a prisoner form the hole enters the prisoner the prisoner compound to go to see his family at visitation; not only is he dressed in bright orange with his hands handcuffed behind his back; BOP personnel clear an area of 50 feet, so that no other prisoner can come within 50 feet of the prisoner. At Yazoo punishment prison, hole prisoners visiting time is cut short.

9. WAIT A MINUTE . This prisoner is in a very low security prison, and he just self-surrendered or was placed into the hole without any charge (alleged BOP investigation). The law clearly states this prisoner is entitled to the same general privileges as all other prisoners that are not in the hole.

F. The BOP“retaliates” for prisoners filing “legitimate” legal claims; or demanding “medical treatment” which the law states the BOP “must” provide and “must” be “provided” to uphold the US Constitution’s 8 th Amendment.

• (1) Retaliation is illegal states 28 CFR § 7.12. Another BOP laugh, as the BOP retaliates every time a prisoner attempts to hold on to their constitutional rights, or their rights under the laws of the United States. • (2) This website and its associates hold an abundance of proof that the BOP in its deliberate retaliation against a multitude of prisoners for complaining about medical; while filing legitimate complaints; not only does the BOP immediately retaliate; it blocks, in a consistent manner prisoners’ access to the court in every form there possibly is. To include shredding prisoners’ complaints, in an attempt to acquire access to the courts for violations of their constitutional rights.

• (3) Not only does the BOP retaliate for the above mentioned unlawful reasons, the BOP retaliates against prisoners because of the laws and BOP policies the BOP violates itself. Most recently, the BOP retaliated against 2,000 prisoners at Yazoo, due only because the BOP violated the constitutional rights and BOP policylaw of prisoners by providing substandard food and poisoning the prisoners at Yazoo. It would have taken a 5-minute talk with the prisoners, and an improvement in the food, to straighten out the serious problem of food, and food poisoning at Yazoo. The BOP didn’t want to do that. R. E. Holt,BOP Regional Director would rather torture the prisoners more by illegally retaliating against all the prisoners. Causing irreparable harm to some.
