The actual accounting of exactly how this conspiratorial group came together ; along with the actual communication between the groups , when they were setting up their second illegal raid ( search and seizure ) of Kimball and his companies on May 12, 1993. The actual faxed communications were acquired from Dana Barnett, President of Somerset Pharmaceuticals and Vice President of Mylan Pharmaceuticals; when Mr. Barnett inadvertently provided Kimball’s attorney at the time, with the wrong documents. These communications were authenticated in court by the private detective agency’s owner; Sean McWeeney, owner of Corporate Risk in Virginia . Sean McWeeney verified that the communications were between he and Dana Barnett and that he perjured himself when he testified against Kimball.

  SOMERSET FABRICATED LETTER TO THE FDA 1991
  
  1. The conspiracy begins with Somerset Pharmaceuticals, Inc., essentially a paper company owned by Mylan and Bolar Pharmaceuticals, sending a letter dated January 2, 1991 filled with untruths to supervisory personnel at the FDA. This letter references a December 20, 1990 complaint letter to the FDA by Somerset Pharmaceuticals. Click below for Somerset's letter (1).

  PASCO SHERIFF'S OFFICE DOCUMENTS
  
  The December 20,1990 letter from Somerset Pharmaceutical caused an illegal search and seizure of Mr. Kimball's car and businesses the very next day, December 21, 1990. Deliberate lies were told to local police authorities by the FDA and the State of Florida Department of Health (DOH, that Mr. Kimball and his business, DEDI, were involved with narcotics.   SOMERSET PHARMACEUTICALS MEMO TO STATE ATTORNEY
  
  Even though Somerset and the FDA knew that Mr. Kimball and DEDI had not developed any products yet, were not selling any products, and did not not possess any narcotics, the FDA, DOH and somerset pressed on for arrest.   Mr. Kimball is arrested in March, 1991 and put in jail. Prior to Mr. Kimball being put in Jail, Detective Tanner, whose written report was referenced in Number 2 of this link, called Mr. Kimball and made arrangements with him to turn himself in rather than issue an arrest warrant. Detective Tanner told Mr. Kimball he didn't need anyone to drop him off as long as he had a check for $20,000.00 for bail.

  Mr. Kimball could drive himself to the police station and meet Detective Tanner, give him the check for $20,000.00, sign some paperwork and drive back home. The whole thing would take about an hour. Detective Tanner said he had to work the day shift and to meet him at the police station around 4:30 p.m.

  The mistake Mr. Kimball made was to believe anything Tanner said. When Mr. Kimball got to the police station Tanner confiscated his car, put Kimball in jail laughing, saying we don't accept checks for bail. The jail was so full, Mr. Kimball had to sleep on a mattress under the TV in a recreation room. Tanner was so smart as to do all this on a Friday night, so that his wife could not pay the bail until the next monday, because in 1991 banks were closed on weekends.

  TESTIMONY OF DR. OWEN, PROFESSOR AT UNIVERSITY OF SOUTH FLORIDA
  
  The FDA, DOH, Somerset and the police department all knew prior to Mr. Kimball's arrest that DEDI and he had not even developed any product yet. In a preliminary hearing Professor Terence Owen testified many times that the product Mr. Kimball was arrested for in 1990 wasn't even developed at that time.

  One Florida judge found the seach of Mr. Kimball's car was illegal, while another Florida judge ordered the return of his car (4 months later), damaged of course. Click on this page for professor Owen's testimony that the product was not developed until the spring of 1991. (5)
